Revocable Trusts

A Revocable Living Trust is a type of Trust that can be altered, amended, or revoked by the person who created it (the grantor or settlor) during their lifetime.

  1. Trust Agreement: A written document in which the grantor transfers legal title of certain assets to the trust, to be managed by a trustee for the benefit of beneficiaries.
     
  2. Revocability: The grantor retains the legal right to change the terms, add or remove assets, or terminate the trust entirely at any time before death (unless limited by law or specific agreement).
     
  3. Trustee: The person or institution responsible for managing the trust assets according to the terms of the trust and applicable law. Often, the grantor can also serve as the trustee while alive.
     
  4. Beneficiaries: Individuals or entities designated to receive benefits from the trust.
     
  5. Purpose: Revocable trusts are often used for estate planning, managing assets during the grantor’s lifetime, and facilitating the transfer of property after death without probate.

Living Will

 A Last Will and Testament — often just called a Will — is a legal document that explains what a person wants to happen to their property, money, and personal belongings after their death.


  • Distribution of Property:
    It specifies who inherits what — for example, leaving a house to a spouse, savings to children, or personal items to friends or charities.
     
  • Executor Appointment:
    The will names an executor who is the person responsible for carrying out the instructions in the Will, paying debts, and handling the estate.
     
  • Guardianship for Minor Children:
    If the testator has young children, the will can name a guardian to care for them.
     
  • Funeral or Burial Wishes:
    Some people include instructions about funeral arrangements or preferences for burial or cremation.

A Living Will is a legal document that explains what kind of medical care or life support you want (or don’t want) if you become too sick or injured to speak for yourself.

It is different from a regular will — a living will is used while you’re still alive, but unable to make decisions.

For example, a living will can say things like:

  • Whether you want to be kept on a breathing machine.
     
  • If you want feeding tubes or life-prolonging treatments.
     
  • Whether you want pain relief even if it might shorten your life.
     

Doctors and family members use your living will to follow your wishes about medical treatment when you cannot communicate them yourself.

A Healthcare Surrogate is a document that allows a person you choose to make medical decisions for you if you can’t make them yourself.

Here’s how it works:

  • You name someone you Trust— your surrogate.
     
  • If you become too sick, unconscious, or unable to speak, that person can talk to doctors, review treatment options, and decide what care you receive based on your wishes.
     

In short, a healthcare surrogate is someone you appoint to speak for you about medical care when you are unable to do so yourself.

A Quitclaim Deed is a legal instrument used to transfer whatever ownership interest a person (the grantor) has in a piece of real property to another person (the grantee), without making any warranties or guarantees about the title.

 

A Lady Bird deed, also called an enhanced Life Estate deed, is a special type of property deed used in Florida to transfer real estate upon your death.  It allows a property owner (the grantor) to retain control of the property during their lifetime and automatically pass it to a beneficiary (the remainderman) upon their death, without going through probate.
